The Terms of Sale ("Terms of Sale") are offered to you by junglekuality.com and its affiliates ("junglekuality.com", "we", "us" or "our") and govern all sales and purchases of products (including hardware and software) and/or services offered by us (collectively, the "Products") on the junglekuality.com online shop at contact@junglekuality.com. The information in the Terms of Sale and the details contained in this web shop do not constitute an offer to sell, but rather an invitation to deal. No contract for the products will exist between you and us until we accept your order. If we do not accept your offer and funds have already been deducted from your account, these will be refunded.

We strive to be as accurate as possible in our product descriptions and support services. However, we do not warrant that the descriptions of Products and/or support services or any other content on the junglekuality.com Web Store are accurate, complete, reliable, current or error-free. If you purchase a Product through the junglekuality.com online shop and believe that it does not conform to the description provided, or if you believe that you have not received support for your Product as provided in the Limited Warranty, your sole remedy is to return the Product in accordance with our Return Policy.

All Product orders are subject to availability and in this regard, in the event of supply difficulties or because Products are no longer in stock, we reserve the right to provide you with information on substitute Products of equal or greater quality and value that you may order. If you do not wish to order these substitute products, we will refund any money you have paid.
We reserve the right to withdraw any product from this website at any time and/or to remove or amend any material or content on this website. Whilst we will do our best to always process all orders, there may be exceptional circumstances which require us to refuse to process an order after sending you an order confirmation, which we reserve the right to do at any time at our sole discretion.
We will not be liable to you or any third party if we remove any product from this web shop, whether or not it has been sold, if we remove or alter any material or content from this web shop or if we refuse to process or accept an order after sending you an order confirmation.
We may keep records of all orders, acceptances and any related documents for a reasonable period after acceptance.
CANCELLATION OF ORDERS
We will cancel your order if: (i) we are unable to accept your order within a reasonable period of time from the date of your order (excluding pre-orders); (ii) payment for your order is incomplete. If we cancel your order, we will refund any previous payment you have made for that product.
Although we take care to ensure that all prices quoted on our online shop are accurate, errors may occur. If we discover an error in the price of one or more products you have ordered, we will notify you as soon as possible and give you the opportunity to reconfirm the order at the correct price or cancel it. If we are unable to contact you, the order will be considered cancelled and if you have already paid for the product(s), you will receive a full refund.
We are not obliged to sell you the Product(s) at the incorrect (lower) price (even after we have sent you an order confirmation) if the pricing error is an obvious typographical or arithmetical inaccuracy and could reasonably have been recognised by you as such.

Full payment must be made prior to our acceptance using the payment methods provided on the junglekuality.com online shop. Payment methods include major credit cards, AmazonPay and Paypal in some areas. We will charge credit and debit cards before products are shipped or services begin.

You may not deduct payment by way of counterclaim or set-off without our prior written consent. We are not responsible for billing errors unless you notify us within fifteen (15) business days of the date of acceptance. In the event that such a billing error is solely attributable to us, we will cancel your order and/or refund any previous payment you have made for that product. We will also authorise a new order for that product.
All software (including preloaded software contained in the hardware) is provided subject to the end user licence agreement for that software. You agree to be bound by that end user licence agreement.
IN NO EVENT shall junglekuality. com, ITS OFFICERS, DIRECTORS, EMPLOYEES OR AGENTS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING THOSE ARISING FROM LOSS OF USE, DATA OR PROFITS, REGARDLESS OF CAUSE OR THEORY OF LIABILITY, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OF SALE, EVEN IF junglekuality. com HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL junglekuality.com's TOTAL LIABILITY (WHETHER FOR BREACH OF CONTRACT, TORT OR ANY OTHER LEGAL THEORY) EXCEED THE AMOUNT PAID BY YOU FOR A PRODUCT WHICH IS MOST RELATED TO YOUR DAMAGES. The foregoing limitations shall apply even if any warranty or remedy provided under this Agreement fails of its essential purpose. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages or the other limitations set forth above, so the above limitations or exclusions may not apply to you.
Without prejudice to the foregoing and to the fullest extent permitted by law, we shall have no liability to you if the Products infringe or are alleged to infringe the rights (including intellectual property rights) of any third party.
You are responsible for obtaining (at your own expense) any licence or consent from any governmental (or other) authority necessary to purchase, transport or use the Products. You agree to provide proof of such licence or consent upon our request.
You agree to comply with any export control laws or regulations applicable to the purchase, transportation or use of the Products.
You shall maintain and promptly update your account information stored with us and you shall protect such information (including but not limited to your user name and password) from unauthorised access.
You represent to us that all information provided by you in connection with your order is current and sufficient for us to process your order.
You will not assume any warranty, undertaking or obligation on our behalf without our express prior written consent.
When you make an offer to purchase a Product, we collect or receive your Personal Information or Non-Identifying Information (as those terms are defined in our Privacy Policy, available on our site). Personal Information and Non-Identifying Information are processed in accordance with our Privacy Policy. By making an offer to purchase a Product, you agree and consent to our Privacy Policy, which we may update from time to time.
APPLICABLE LAW

In this case, junglekuality.com may decide to cancel your order and refund any payments made.
ENTIRE AGREEMENT
You acknowledge that these Terms of Sale supersede and replace all prior agreements or understandings, oral or written, express or implied, between you and Nom de boite with respect to your ability to purchase goods or services from the junglekuality.com online shop. Any terms and conditions to the contrary are excluded to the fullest extent permitted by law.
TRANSLATION
These conditions of sale may be translated into any other language. However, in the event of any inconsistency between the French version and the translated versions, the French version shall at all times prevail and take precedence.
